A federal judge warned Friday that President Trump’s executive order seeks to withdraw funds from 16 shelter jurisdictions cannot be used to bypass his previous ruling to stop the work.
U.S. District Court Judge William Orrick said their “pre-enforcement” granted municipalities legal stance to interact with Immigration and Customs Enforcement (ICE) in the way they chose.
“With all these considerations, I clarify that Executive Order 14,287 and any other government actions that extend the scheduled ban cannot be used as final actions around the preliminary ban,” Obama-appointed Orrick wrote.
Ollick directed the government to clarify written notices of its orders to all departments and agencies by Friday. He noted that the ban applies to government “prohibited conduct”, including existing executive orders and unpublished executive orders.
The Trump administration has fought many court battles over false deportations and illegal removals. Since November, White House officials said their goal is to carry out the largest deportation in the country’s history.
Last September, then-President-elect Trump suggested that the country ban the sanctuary city as a whole.
“Once I take office, we will immediately surge federal law enforcement to every failed city, which are many of them to keep criminal foreigners out of the door, and we will hunt and capture every member of the gang, drug dealers, rapists, murderers, murderers and immigration criminals who are illegally taken refuge,” he said.
“I will ask Congress to pass laws on shelter cities nationwide, and we require the full weight of the federal government on any jurisdiction that refuses to cooperate with it (immigration and customs enforcement).
The Trump administration has incorporated federal law enforcement and agencies into Florida’s ice operation, resulting in the arrest of more than 1,000 undocumented immigrants.
Legislators have not received a proposal to ban shelter jurisdictions.
