Former FBI Deputy Director Andrew McCabe said on Sunday that federal authorities did not contact him during an investigation into former FBI Director James Comey.
McCabe told host Jake Tapper in an interview with CNN’s ITU that it would be “incredible” for him to not ask for a conversation with him, given McCabe’s statement about the incident ahead of the 2016 election.
“Yes, Jack, Jack. I’m not contacted. I’m not interviewed, I’m not asking for an interview,” McCabe said.
“Of course, if my interaction with Jim Comey nine years ago in October 2016 would be the basis for the entire prosecution, it is incredible to think that the prosecutor at least doesn’t want to sit down and listen to what I said.”
Last week, a federal grand jury indicted Comey for a charge of making false statements and another obstruction of a congressional lawsuit related to his testimony in the Senate.
The federal charges stem from exchanges between Comey and Sen. Ted Cruz (R-Texas) at a Senate Judiciary Committee hearing on September 30, 2020. Cruz asked Comey and McCabe about leaks from the Wall Street Journal about investigations in the days before the Clinton election.
McCabe said Comey knew about and authorized the leak. Comey insists he is not aware of the leak, and McCabe also hinted in a conversation after the story was published that he wasn’t involved either.
A 2018 Inspector General Report supported Comey’s account, saying McCabe authorized the leak, “lack of candidness”, when he told the boss and later investigators that he hadn’t leaked.
“What Mr. McCabe is saying, it is impossible that you testify to the committee. One or the other is wrong. Who is telling the truth?” Cruz pressed.
Comey replied, “I can only speak to my testimony. I support your summary testimony.”
The charging documents accused Comey of authorizing an unnamed “Man 3” to leak details of the FBI investigation. ABC News and CNN reported Friday that Columbia Law School professor Daniel Richman had previously confirmed leaked a memo he received from Comey detailing the then-director’s interaction with Trump.
The indictment also says Comey was denied to lie when the FBI authorized others to be anonymous sources of news reports about the Trump or Clinton investigation.
Jake I can only say about this, I don’t know that Jim Comey once authorized others to leak information. This is not what I have experienced personally. This is not what I see when I work around Jim Comey. ”
“So, I can’t sit here to describe his testimony – I don’t think it’s far from clear enough to be the basis for false statements or perjury prosecutions – but I can only say it’s revealed by my own experience, that is, I never saw Jim Comey authorize others to leak information.”
